All lots shall be used for single family residential purposes only. One
single family, one story structure
consisting of no less than 1300
square feet of heated floor space
will be allowed per lot. In the case
of a two-story structure, the bottom
floor must consist of a minimum of
1000 square feet of heated space.
No structure shall exceed two stories in height.
No structure shall be built or erected
from concrete masonry or cinder
blocks. All exterior structures shall
be of brick, stucco, wood frame,
or vinyl. All exterior wood surfaces
shall be painted or stained with
two coats of same. No structure
or residence shall be lived in until
home is totally completed inside and
outside. All excess building materials, scraps, debris, etc., associated
with the construction of the dwelling
shall be removed from the property
immediately upon completion of
construction. All plans and specifications of construction of homes shall
be approved by the Developers,
Kenny W. Durden, Jr., and James A.
Brooks, prior to construction.
All structures placed on lots, either
residences or outbuildings, must
be approved by the Burke County
Building Inspector prior to placement on lots.
No commercial businesses shall be
allowed on any of the lots in Blocks
A, B, C or D. The lots in Block "E"
may be allowed to have some types
of small businesses only with the
written approval of the Burke County
Land Development Authority.
Any and all outbuildings shall be
placed behind the main dwelling.
The homeowners may place a
manufactured storage building on
the property, but only if it is of good
quality and the exterior shows no
damage. If a storage building is
built, it must be built to meet all
county codes and it must conform
to the aesthetic appearance of the
surrounding residences. No shack,
tent, lean-to, old mobile home, etc.
shall be on the property to be used
as a storage building.
No trailers, mobile homes, modular
homes, manufactured or prefabricated homes shall be allowed as
residences or for other purposes
on any lot. Each residence shall be
built from ground up, and shall be
built by a licensed contractor, unless
otherwise approved by Developers,
Kenny W. Durden, Jr., and James
A. Brooks. In the event that the
Developers, Kenny W. Durden, Jr.,
and James A. Brooks, approve an
individual to build or subcontract his/
her own home or a home for resale,
the Developers, Kenny W. Durden,
Jr., and James A. Brooks, shall have
the right to approve all plans and
specifications prior to construction.
Individuals may be required to give
references and allow Developers,
Kenny W. Durden, Jr., and James
A. Brooks, to visually inspect prior to
construction projects before granted
permission to construct the residence. The Developers, Kenny W.
Durden, Jr., and James A. Brooks,
reserve the right to refuse any
individual from constructing his/her
own residence or one for resale.
Any construction on any lot, whether
residences or out buildings shall be
completed within six months from
the beginning date of construction.
No farm animals of any kind shall
be allowed on any one acre lot.
This includes poultry, swine, cows,
goats, mules, horses or livestock of
any kind. Lots 1 through 7 of Block
"E", the large lots on the back side
of the property, shall adhere to this
restriction, with the exception that
they can have horses, if desired.

No junk or unserviceable automobiles, trucks, or other motorized
vehicles shall be placed or kept on
said property. No mechanic work or
repairs shall be done on any motorized vehicle in the driveway, yard, or
other visible location.
Said property shall be kept clean of
rubbish, weeds, undergrowth, and
the like at all times and the entire
property shall be kept in neat clean,
and attractive condition.
All areas disturbed by contraction
shall be smoothed and seeded in
grass or other vegetation for the
prevention of and control of erosion.
No portion of any property shall
be allowed to erode and become
unsightly.
Nothing illegal, noxious, offensive,
undesirable, or dangerous shall be
carried on at said property. Anything
deemed annoying or a nuisance
shall be prohibited.
No property shall be divided or subdivided into tracts, lots, or parcels of
less than size tracts shown on the
recorded plat.
No more than four dogs shall be
kept on said property. All dogs shall
be kept in a pen, except when accompanied by the owners. No dogs
shall be allowed to run free through
the neighborhood.
If propane tanks are placed on lot,
they shall be placed in the rear of
the residence.
No cars shall be parked in the front
yard of residences, or on the street.
All lots are being sold subject to utility easement requirements.
